i have this question i hope you can help me. San po bang LAW nka-stipulate yung regarding sa PAG-SIGN and SEAL ng PLANS and Drawings when you are WORKING UNDER A COMPANY?… saka kung panu yung compensation sa ganung scenario is it the same lang po ba sa UAP DOC202?… kasi po sa opis nmen pnagsisign ng plans ang architects pero wala nmng additional sa salary/ incentives… Pag under ba sa company ang isang Architect the company can require him/her to sign??… -

You cannot refer him to any code since what we have learn from school is not really the thing we will use in practice. (Take note, this is only in Philippines ha…. in U.S. they are abiding their law and they have revise their architectural code to meet current practice —-marketing, fees etc. —-yung sa code natin is based pa sa old reference ng AIA). To answer Rowell question, depende yan sa job description mo. If you are the principal owner or stockholders of the company and your job description includes signing and sealing of drawings… okay lang yun. Pero kung Employed ka lang and you are not part incorporators of the company… Your company (IF a registered in DTI or SEC) is in violation of their own Scope of works or offering services not included in their “articles of incorporation” etc. So pwedeng construction lang talaga ang function nila pero nagooffer na rin sila ng design. Aanyway since puro illegal naman ang practice natin sa bansa natin… You can ask for additional compensation sa pag sign and seal mo SINCE you will assume the responsibility of your company’s illegal practice. Hehehe.. tinatakot lang kita… joke.. normally nasa 1-3% yan ng project cost (based dun sa isang construction firm) or pwede ring 5-10% ng total professional fee… (based dun sa archi firm na walang architects). BUT it will not be based on DOC 202 kasi nga yun yung “unrealistic ang minimum” natin. Have a close talk to your general manager which is a CE (i guess), and tell him that signing and sealing of drawings will make you the “architects of record” and has also a liability in the law and it is not part of your job description and you will need additional compensation for that task (kung magkano napagkasunduan, ikaw na magassess kung lugi ka ba or hindi) and have also the right NOT to sign those drawings. BTW, IF EVER the IAPOA catches your illegal practice, you will not be spared. weh LOL,

Rolando Mijares Rowelll, As long as hindi ikaw ang nag issue ng official reciept… wala kang problem sa VAT. pero kung additional compensation sya.. pwede nila isama yung sa 2316 mo as additional income then taxable na yun kasama ng salary mo. Pero since alam naman natin na “illegal ang lahat”. The best you could do is to make and x-deal with your boss, how much, kaliwaan nalang and wag na isama sa salary mo. Basta inform them that you need additional compensation since it is not part of your job description. goodlucks!
